NAWA - Terms of Service

Welcome to NAWA, a local social chat app developed by N00Klab.

By downloading or using NAWA, you agree to these Terms of Service ("Terms"). If you do not agree, please do not download or use the app. These Terms constitute a legally binding agreement between you and N00Klab.

1. About NAWA

NAWA is a local chat experience designed to help people discover and exchange short messages based on proximity, timing, and curiosity.

NAWA does not guarantee that you will meet, connect with, receive replies from, or have any meaningful interaction with other users.

NAWA is intended for entertainment and social discovery purposes only and should not be relied upon for emergency communications or critical personal needs.

2. Eligibility and Age Requirement

You must be at least 17 years of age to use NAWA. By using the app, you represent and warrant that you meet this age requirement.

We use Google Sign-In and Apple Sign-In for authentication. By signing in, you represent that your use of those services complies with their respective terms and that you meet NAWA's age requirement.

We reserve the right to terminate or restrict accounts if we have reason to believe the age requirement is not met.

3. User Responsibility

You are solely responsible for the messages, profile information, and any content you create, send, or share through NAWA.

You agree not to use NAWA to:

• Harass, threaten, abuse, intimidate, or target other users
• Send hateful, discriminatory, sexual, violent, obscene, or illegal content
• Impersonate another person or entity
• Share private or personally identifiable information about others without their consent
• Spam, scam, phish, or manipulate other users
• Use the app for any illegal activity or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to the app, servers, or other users accounts
• Reverse engineer, decompile, or attempt to extract the source code of the app
• Use the app in any way that could damage, disable, or impair the service

We may remove content, limit access, suspend accounts, or permanently delete accounts if we believe these Terms have been violated, at our sole discretion and without prior notice.

4. Location-Based Features

NAWA may request access to your device location to enable local messaging features. Location access is used solely to facilitate proximity-based matching and is not sold or shared with third-party advertisers.

Your approximate location, such as city or regional level, may be indicated to other users as part of the core app experience. Your precise GPS coordinates are not disclosed to other users.

Because NAWA is based on local interaction, other users may be able to infer that you are within a general nearby area. You are responsible for exercising appropriate caution when communicating with others.

You may withdraw location permissions at any time through your device settings. Doing so may limit or disable certain features of the app.

5. Messages and Content

Messages sent through NAWA may be delivered to other users depending on how the app is designed and configured. Message delivery is not guaranteed.

You should not share sensitive personal information, financial information, passwords, home addresses, or any content you would not want a third party to see.

By submitting content through NAWA, you grant N00Klab a non-exclusive, royalty-free, worldwide license to use, store, and process that content solely for the purpose of operating and improving the service. This license does not grant N00Klab any right to sell your content to third parties.

6. Reporting and Safety

If you encounter abusive, offensive, or inappropriate content or users, you may report them through the in-app reporting feature.

We may review reported content and take action when appropriate, including removing content, warning users, restricting access, or terminating accounts. We are not obligated to take action on every report.

NAWA is not a substitute for law enforcement. If you believe you are in danger or have witnessed illegal activity, contact your local emergency services immediately.

7. Account and Access

You may need an account to use certain features of NAWA. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You may delete your account at any time through the Settings menu within the app. Upon deletion, your profile and associated messages will be removed in accordance with our Privacy Policy. Some data may be retained for legal compliance or safety purposes.

Your use of NAWA is also governed by our Privacy Policy, available within the app and incorporated into these Terms by reference.

8. No Guarantee of Availability

NAWA may change, pause, update, or discontinue any features or the service as a whole at any time, with or without notice.

We do not guarantee that the app will always be available, error-free, secure, or uninterrupted. We are not liable for any loss resulting from downtime, data loss, or service interruptions.

9. Intellectual Property

NAWA, N00Klab, the app name, design, branding, code, and all related materials are owned by N00Klab unless otherwise stated. All rights are reserved.

You may not copy, modify, distribute, sublicense, reverse engineer, or use our branding, code, or app materials without express written permission from N00Klab.

User-generated content remains your property. By submitting content, you grant us the limited license described in Section 5.

10. Termination

We may suspend or permanently terminate your access to NAWA at any time, with or without notice, if you violate these Terms, misuse the app, create safety risks, or harm the experience of other users.

You may stop using NAWA at any time. Account deletion is available through the app Settings.

Upon termination, your right to use the app ceases immediately. Sections 9, 11, 12, 13, 14, and 15 survive termination.

11. Disclaimer of Warranties

NAWA is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, N00Klab expressly disclaims all warranties. We do not warrant that the app is free of viruses or other harmful components, or that any defects will be corrected.

12. Limitation of Liability

To the maximum extent permitted by applicable law, N00Klab, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or relating to:

• Your use of or inability to use the app
• User-generated content or the conduct of other users
• Any unauthorized access to or use of our servers or personal information
• Any interruption or cessation of the service
• Any offline interactions or consequences arising from in-app communications

In no event shall N00Klab's total cumulative liability to you exceed the greater of (a) the amount you paid to N00Klab in the twelve (12) months preceding the claim, or (b) USD $0 if you have not made any payments.

13. Indemnification

You agree to defend, indemnify, and hold harmless N00Klab and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your use of NAWA; (b) your violation of these Terms; (c) any content you submit or transmit through the app; or (d) your violation of any rights of another person or entity.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of NAWA shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in Seoul, Korea, under the rules of the Korean Commercial Arbitration Board (KCAB).

Notwithstanding the foregoing, N00Klab reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent unauthorized use of its intellectual property.

15. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the remaining provisions.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and N00Klab regarding your use of NAWA and supersede all prior agreements.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in the law, our practices, or our services. The updated Terms will be posted within the app with a new Effective Date.

If we make material changes, we will notify users through the app or via the contact email on file. Your continued use of NAWA after the Effective Date constitutes your acceptance of the changes.

NAWA is a local social chat app developed by N00Klab. This Privacy Policy explains what information we collect, how we use it, how we protect it, and what choices you have. By using NAWA, you agree to the practices described in this Privacy Policy.

1. Information We Collect

We collect the following categories of information depending on how you use NAWA:

Account Information:

• Email address or login identifier provided through Google or Apple authentication
• Display name or profile information you choose to set
• Gender selection and avatar preference
• Account settings and preferences

Location Information:

• Approximate device-based location, such as city and region level, when you grant location permission
• General geographic area used to support local message features
• Location data is not stored with precision beyond what is necessary for app functionality

Message and User Content:

• Messages you send or receive through the app
• Profile content you create
• Reports you submit about other users or content

Device and Technical Information:

• Device type and model
• Operating system and version
• App version
• Crash logs and diagnostic data
• Push notification tokens, if you enable notifications

2. How We Use Information

• To provide and operate NAWA's local chat features
• To deliver and manage messages based on app functionality
• To authenticate your identity via Google or Apple Sign-In
• To maintain and secure your account
• To improve app stability, performance, and user experience
• To respond to support requests and feedback
• To review reports and protect user safety
• To detect, prevent, and address abuse, spam, fraud, or misuse
• To comply with applicable legal obligations
• To enforce our Terms of Service

We do not use your information for advertising, profiling for commercial purposes, or sale to third parties.

3. Location Data

NAWA requests location permission solely to support proximity-based message features. We collect approximate location at the city or regional level. Your precise GPS coordinates are not disclosed to other users.

Because NAWA is designed around local interaction, other users may understand that you are within a general nearby area. This is inherent to the app's core functionality.

You can control or revoke location permission at any time through your device Settings. Disabling location access may limit or disable certain features of the app.

Location data is not retained beyond what is necessary to provide the service and is not sold or shared with advertisers.

4. Messages and Content

Messages and user-generated content may be stored as necessary to provide the app, allow users to manage their messages, review abuse reports, and maintain platform safety.

If you report a message or user, we may review related content to assess the report and take appropriate action. Reviewed content may be retained for a limited period for safety and legal purposes.

Deleted messages are marked as removed from your view. Certain data may be retained in our systems for a limited period for safety, legal compliance, or dispute resolution purposes before permanent deletion.

5. Sharing of Information

We do not sell, rent, or trade your personal information to any third party.

We may share limited information only in the following circumstances:

• With service providers that help us operate the app, strictly for that purpose and bound by confidentiality obligations
• To comply with applicable law, legal process, court orders, or government requests
• To protect the rights, property, or safety of users, N00Klab, or the public
• In connection with a merger, acquisition, financing, or sale of assets, in which case users will be notified

Any third parties with whom we share data are required to handle it in accordance with applicable privacy laws and our data processing requirements.

6. Third-Party Services

NAWA relies on the following third-party services to operate. Each service processes data according to its own privacy policy:

• Supabase - database, authentication, and backend infrastructure (supabase.com/privacy)
• Google - authentication via Google Sign-In (policies.google.com/privacy)
• Apple - authentication via Apple Sign-In (apple.com/legal/privacy)
• DeepL - in-app message translation (deeplpro.com/en/privacy)

We encourage you to review the privacy policies of these services. We are not responsible for their data practices.

7. Data Retention

We retain personal information only for as long as necessary to:

• Provide the app and its features
• Maintain platform safety and security
• Comply with applicable legal obligations
• Resolve disputes and enforce our Terms

When information is no longer needed for these purposes, we delete or de-identify it. Account deletion requests are processed within 30 days, subject to legal retention requirements.

8. Account Deletion

You may delete your account at any time through the Settings menu within the app. Upon deletion, your profile, messages, and associated personal information will be removed from active systems within 30 days.

Certain information may be retained beyond this period if required by law, for fraud prevention, safety investigations, or legitimate operational reasons. Retained data will be de-identified where possible.

9. Your Rights and Choices

Depending on your location and applicable law, you may have the following rights:

• Access: Request a copy of the personal information we hold about you
• Correction: Request correction of inaccurate or incomplete information
• Deletion: Request deletion of your personal information, subject to legal exceptions
• Portability: Request a copy of your data in a machine-readable format
• Objection: Object to certain uses of your information
• Withdrawal of Consent: Withdraw consent for location access or push notifications at any time through device Settings

10. California Privacy Rights (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

• The right to know what personal information is collected, used, shared, or sold
• The right to delete personal information we have collected, subject to exceptions
• The right to opt out of the sale of personal information. We do not sell personal information.
• The right not to be discriminated against for exercising your privacy rights

11. Children's Privacy

NAWA is not intended for users under the age of 17. We do not knowingly collect personal information from anyone under 17.

If we learn that we have collected personal information from a user under 17 without appropriate parental consent, we will take immediate steps to delete that information and terminate the account.

12. Security

We implement reasonable technical and organizational measures to protect your information against unauthorized access, loss, misuse, alteration, or destruction. These measures include encrypted data transmission, access controls, and secure infrastructure provided by our service partners.

However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security and are not responsible for unauthorized access beyond our reasonable control.

In the event of a data breach that affects your rights and freedoms, we will notify affected users and relevant authorities as required by applicable law.

13. International Users

NAWA is operated from the United States. If you access the app from outside the United States, your information may be transferred to and processed in the United States or other countries where our service providers operate.

By using NAWA, you acknowledge and consent to the transfer of your information to countries that may have different data protection laws than your country of residence.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in law, technology, or our practices. The updated policy will be posted within the app with a new Effective Date.

If we make material changes that significantly affect your rights, we will notify you through the app or via your registered email address. Your continued use of NAWA after the Effective Date constitutes acceptance of the updated Privacy Policy.
